Hemp THC Rules Are Changing: What THCa Flower Buyers in Pennsylvania Should Know

Last checked October 13, 2026. This area of law is moving.

This is general information, not legal advice.Cannabis law varies by state and changes often. Confirm current rules with your state's official cannabis regulatory agency before acting on anything here.

What is changing

In late 2025 Congress changed the federal definition of hemp. The old test looked at delta-9 THC alone, at 0.3 percent by dry weight. The new test counts total THC, which includes THCA, the acid form found in raw "THCa flower," and limits a finished product to 0.4 milligrams of total THC per container. A hemp product above that limit is treated as marijuana, which is still a Schedule I controlled substance under federal law. Most hemp-derived THC flower, gummies and drinks are above it.

The rule was set to start on November 12, 2026. On September 2, 2026 the President signed H.R. 6500, a short-term funding bill, which moved the start to December 11, 2026 for naturally derived products. Synthetic cannabinoids, meaning ones the cannabis plant cannot produce naturally, keep the November 12, 2026 date. The delay gives Congress time to write rules for hemp products instead of banning them, and lawyers following the issue expect more action before the date. It could change again.

What this does not change

Licensed medical marijuana is a different legal category from hemp. The new test redefines hemp. It does not change Pennsylvania's medical marijuana program, its patient certification and card, or what its licensed dispensaries may sell to patients under state law. Pennsylvania sets those rules, and the state Department of Health runs the program.

What this means for people who buy THCa flower

THCa "hemp" flower is the kind of product the 0.4 milligram limit is aimed at. If you buy it today, expect it to become harder to find around the date, and expect state and local rules to keep their own timelines whatever Congress does. Pennsylvania and some of its cities have been considering their own hemp rules, so check what applies where you live.

MaryJane & Me is not a store and does not sell or recommend hemp products. We read the menus of licensed dispensaries (125 in Pennsylvania right now) and show what is in stock and at what price. If you are a Pennsylvania patient, you can see current flower prices by size and store on our Pennsylvania dispensaries page, and which strains are in stock near you on each strain page, for example Blue Dream. Flower from a licensed dispensary is tested and labeled under the state program.

If you are not a patient yet

Pennsylvania patients need a certification from a registered practitioner and a medical marijuana card. The Department of Health explains who qualifies and how to apply. See the Pennsylvania medical marijuana program. For how medical and adult-use programs differ across states, see our legal status guide.
